EXECUTIVE ORDER (No 3 of 2007)

SURRENDER AND RENEWAL OF STATE LEASES

Preamble
The grant of State land to individuals and corporate bodies is usually made on lease-hold basis for a term of years not exceeding 99 years. In some other instances the term of years may be much less than 99 years depending on the nature of the grant.

As expected, the interest on land so granted by the government would continue to reduce until its expiration through effluxion of time. In the management of such leases, the State Government usually encounters three major situations through:

i) Total expiration of term of years granted:
Where the term of years has expired, the holding with the improvements there on is expected to revert to the State Government. The Government is then at liberty to grant a fresh term of years to the holder or any other interested party.

ii) Request for elongation of the term:
With regard to this request for elongation, a supplemental deed is prepared to vary the terms and conditions contained in the title document held by the holder.

iii) Request for surrender of an interest for the purpose of obtaining a fresh term:
This is where the holder chooses to surrender the interest before the expiration with the objective that the State Government will grant a fresh term thereby creating a new interest.

Order
By the authority invested in me as Governor under and by virtue of the 1999 Constitution, I hereby reaffirm that no approval may be granted for the requests stated in para 2(i), (ii), (iii) including the applicable charges without my approval. The power to grant such approvals can only be exercised by the Executive Governor of Lagos State.

This order is intended to improve the internal management of the State Government and is not intended to, and does not create any rights or benefits, substantive or procedural, enforceable at law or in equity by a party against Lagos State, its departments, agencies, or entities, its officers, employees, agents, or any other person.
